GENERAL TERMS AND CONDITIONS

1. PAYMENT

Net 30 terms are only extended to stocking dealers upon credit approval by Crystorama. If you are a stocking dealer and would like to apply for open credit, a credit application must be filled out and sent to Crystorama. We can arrange prepay for Crystorama accounts when needed. Please mail payments to P.O. Box 419876, Boston, MA 02241-9876 or email ar@crystorama.com for credit card instructions.  Prices are subject to change without notice.  Any promotional pricing and/or any special pricing arrangements from Crystorama must be reflected on the submitted purchase order and is only valid for invoices paid within terms.  If invoice is not paid within terms, Crystorama promotional price is voided.

2. ORDER ACCURACY

All orders are subject to acceptance by the factory. All purchase orders must include price information. Email orders to orders@crystorama.com or fax to (516) 931-1254. Submitted orders cannot be canceled or modified after the factory begins processing the order. All cancellation requests must be submitted in writing.

3. CUSTOM PROCESS

Custom orders require a 50% deposit with balance due before delivery. Custom orders are final sale and non-cancelable.

4. SHIPMENT

We reserve the right to select the shipping carrier, unless specified in advance by the customer. See the Ship Via column to identify how that item ships.  Dimensional weight as indicated on the price sheet as 'dim shipping weight' is the billable weight not the actual weight. Crystorama will Drop Ship direct to final user.  Drop ship fees are waived.

5. ASSEMBLY PRODUCT LEAD TIME

Our lead times can vary depending upon our production schedule and depending upon the size and complexity of a given order.  In stock chandeliers are assembled and wired at no extra cost, but we reserve the option to ship knock down (KD) when, in our judgement, they are too large, or the possibility of breakage is too great. All glass arm crystal chandeliers are shipped KD. Custom order may be subject to a fee if extra wire is required. All rewiring is subject to $25.00 fee per unit.

6. RETURNS

All returns must be authorized, in advance, by factory by emailing returns@crystorama.comCustom orders are not eligible for return. Unauthorized returns may be refused. Goods must be returned in the original carton, with original packaging via pre-paid shipping, within 30 days of receipt of shipment. Buyer's remorse returns are subject to a 30% restocking fee and the original freight will not be refunded. Returns that are received in anything other than the original carton or if the crystals are opened, a 50% restock fee will be charged.

7. CLAIMS 

Claims for lost or damaged items must be filed with the carrier. Note: Customer must file their own claim with the carrier if the order is shipped using their provided carrier account. In the event you require replacement parts, please email parts@crystorama.com along with the original purchase order number within 30 days of receipt of merchandise. 

8. WARRANTY

Crystorama warrants that our products are free of defects in workmanship and materials for a period of one year from the date of shipment from our factory. Any such defective products will be repaired or replaced, provided a written claim is made within the warranty period. The decision whether to repair or replace is at the sole discretion of Crystorama Lighting. The company will not accept any charges for labor, repair costs or transportation charges incurred without prior written authorization from our factory. The responsibility of the company for any defective material is limited solely to the replacement or repair of the material and does not include any incidental or consequential damages which may occur. No warranty expressed or implied exist other than the ones indicated above. No person, agent or distributor is authorized to give any other warranty on behalf of the company.

9. WARRANTY DETAILS
Crystorama lighting fixtures (both indoor and outdoor), when properly installed and under normal conditions of use, are warranted to be free from defects in materials and workmanship for one year from date the product was shipped to the original end use purchaser. Crystorama, upon confirmation of a defect will, at its sole discretion, repair or replace, F.O.B. Factory, freight prepaid, any lighting product defective in materials or workmanship within the warranty period above. Such repair or replacement is the exclusive remedy against Crystorama should any product delivered prove defective, subject to the following conditions and exclusions.

What is not covered: Our warranty covers the product itself and the following costs, expenses and damages are not covered by the provisions of this limited warranty: (i) labor costs including, but not limited to, such costs as the removal and reinstallation of Product; (ii) shipping and freight expenses; (iii) any other additional losses. All discontinued items are final sale and not covered under this warranty. The provisions of this warranty do not apply to Products: (i) used in commercial applications; (ii) used for purposes for which they are not designed or intended; (iii) which have been subjected to modification, abuse, misuse, negligence or accident; (iv) which have been improperly stored, installed, maintained or operated; (v) which have been used in violation of written instructions provided by Crystorama; (vi) which have been subjected to improper temperature, humidity, floods or other environmental conditions; or (vii) which, based on Crystorama's review, do not disclose to Crystorama's satisfaction a defective in materials or workmanship. Additionally, this warranty does not cover scratches, abrasions, or deterioration due to the use of paints, solvents, chemicals, or abrasive cleaning techniques.

Finish Warranty Exclusions: Outdoor Finishes: Lighting fixtures installed outdoors are subject to change due to prolonged exposure to sunlight, pollutants, and other environmental conditions. Metal finishes on outdoor fixtures will mature naturally over time, and may change in appearance, creating a living finish. Painted finishes on outdoor fixtures may naturally fade over time, depending on the fixture's exposure to the outdoor elements. Therefore, any claim for fading, discoloration, or "patina" of a finish on an outdoor fixture is not applicable to the above warranty. Coastal Environments: The environment within ten miles of a seacoast can be extremely corrosive. Even with appropriate maintenance, products installed in this environment will typically deteriorate more than products installed in other, less severe environments. Corrosion and/or deterioration is considered "normal wear" in this environment. Therefore, any claim for finish failures, or for corrosion of other components due to coastal environment conditions is not applicable to the above warranty.

WARRANTY SERVICE: (i) is available for the original end use purchaser only, (ii) must provide the original bill of sale, delivery date, and product number and (iii) the customer must return for inspection the defective parts or fixture at the request of Crystorama. IMPLIED WARRANTIES INCLUDING THAT OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE EXPRESSLY LIMITED IN DURATION TO THE DURATION OF THIS WARRANTY. FOR BREACH OF ANY WRITTEN EXPRESS OR IMPLIED WARRANTY ON THIS PRODUCT, THE CONSUMER IS LIMITED EXCLUSIVELY TO THE REMEDIES PROVIDED IN THIS WARRANTY. IN NO EVENT SHALL CRYSTORAMA BE LIABLE FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL DAMAGES SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.
